Defective Product Injury

Today, tragically, many corporations put huge profits over the safety of individual people. When a corporation designs or manufactures a defective or dangerous product that causes injuries or death to an person, that corporation should be held accountable. Also, when a corporation knows that a product is defective or dangerous it is required by law to warn the public. When a corporation hides this information and puts profits over the safety and lives of people that corporation is liable, and must be held accountable.

Many of these cases involve defective automobile or defective automobile parts. Some of the most notable examples of these cases include the Ford Pinto, Firestone tires, exploding tires, defective wheels, vehicles that rollover, and seatbelts that are known to be defective. Pekor & Associates recently represented the family of a young man who was killed in a car accident when his seatbelt failed due to a design defect – a design defect that the auto manufacturer knew about! In another case, we represented a young man whose leg was almost severed due to a faulty transmission, which had a tendency (known to the manufacturer!) to jump from “park” into “reverse.”

Lawsuits have increased consumer awareness. In some cases manufacturers now try to recall vehicles and repair or replace defective parts before lives are destroyed.

There are so many examples of defective and dangerous products that we cannot list them all here. Examples include: child safety seats, clothing made from flammable material, defective baby beds, defective water heaters that cause scalding or third degree burns, defective lighters, defective machinery of all types, machinery that does not have safety guards, saws, conveyor belts, chemicals, lawnmowers, and aircrafts or aircraft components.

There are also many drugs that cause severe disability and death. We are all familiar with many of these drugs: Fen-Phen, Baycol, Propulsid, Phenylpropanolamine (PPA), and many others. These medications are known to cause heart damage, liver damage, muscle damage, hemorrhagic stroke, brain damage and other complications.

If you or a family member have been injured as a result of a defective or unsafe product or drug, we believe you should immediately seek the advice of an attorney to make sure that your rights are preserved. If you would like to discuss your case with us, please contact us as soon as possible.

Time is often critical in these types of cases. For example, we only have a limited time to bring a lawsuit, and it is also usually a necessity that we acquire or preserve the defective product. Our firm has purchased automobiles that seriously injured or killed our client due to a product defect just before the car was sent to the crushing machine! Without the car, it would have been impossible to pursue the case! If the client’s family had waited a few more days to contact us, the car would have been destroyed in the crushing machine, and there would have been no way prove that the defect In the car caused their loved ones death.
